U.S. Department of Education investigates MPS for school disciplinary practices that consider race

The U.S. Department of Education has opened an investigation into Milwaukee Public Schools, alleging that the district's disciplinary framework improperly considers race when punishing students. Federal officials say the current approach violates civil rights law, specifically Title VI of the Civil Rights Act of 1964, which prohibits discrimination based on race, color, or national origin in any program receiving federal funding.

According to the notice sent to the district, the investigation centers on policies that appear to adjust disciplinary outcomes based on a student's racial background. The department argues that such practices create unequal treatment, even if intended to address historical disparities. MPS has not yet issued a detailed public response, but district leaders have previously defended their approach as a way to reduce suspensions and expulsions among minority students, citing data showing disproportionate rates of punishment for Black and Hispanic students compared to their white peers.

The probe comes amid a broader federal push against what critics call "race-based" school rules. If the investigation finds noncompliance, MPS could face loss of federal funding or be required to rewrite its discipline code. Local advocacy groups are split, with some praising the federal action as a necessary check on discriminatory policies, while others warn that removing race-conscious measures could worsen existing inequities in school discipline. The district has 30 days to respond with documentation of its current practices.
