The Trump administration has finalized an agreement to transfer oversight of many special education programs away from the U.S. Department of Education. This move fulfills a long-standing promise to redistribute federal responsibilities for students with disabilities. Under the deal, key functions related to the Individuals with Disabilities Education Act, or IDEA, will be handed over to other federal agencies, including the Department of Health and Human Services.
Supporters of the plan argue that special education services are more closely aligned with health and social services than with academic curriculum. They believe the shift could streamline services and reduce bureaucratic overlap. Critics, however, warn that the change may disrupt protections for millions of students. Advocacy groups have raised concerns about a loss of oversight and potential delays in funding and compliance enforcement.
The agreement marks one of the most significant reorganizations of federal education policy in decades. While the Department of Education will retain some roles, such as civil rights enforcement, the bulk of special education administration will now fall outside its purview. The transition is expected to take place over the next year, with detailed implementation plans still being developed. Lawmakers on both sides have called for hearings to examine the impact on students, families, and school districts.
