The Protect Education Act, despite its reassuring name, does far less to protect students than its supporters claim. In reality, the legislation functions as a power grab, building a permanent legal structure that could strangle educational options for Arizona's most vulnerable children.
Disabled students stand to lose the most. The act creates new layers of bureaucratic oversight that make it harder for families to access specialized programs outside the traditional public school system. Parents who have fought for years to find the right placement for a child with autism, dyslexia, or other disabilities may suddenly face additional hurdles. The law does not expand services or funding for special education. Instead, it tightens control over how education dollars can be used, limiting the flexibility that many families rely on.
School choice advocates warn the bill undermines the very progress Arizona has made in offering alternatives to failing district schools. Empowerment Scholarship Accounts, which allow parents to direct funds toward private schools, therapies, or tutoring, could face new restrictions. For low-income families who depend on these options, the act threatens to close doors that were just beginning to open.
The bill's supporters frame it as a measure to ensure accountability. But critics argue the real goal is to centralize power and reduce competition. When parents lose the ability to choose what works for their child, the word "protect" becomes hollow. Arizona's disabled students and their families deserve real protection, not a law that traps them in a system that has already failed them.
